Return management and right of withdrawal

Article 1 : Right to Withdraw

According to D. Lgsl. 206/2005 and subsequent changes, concerning consumer protection in long-term contracts, Naturalmente Marylin informs the customer of the following:
(a) The Customer may exercise the right of withdrawal within 14 days of receiving the goods ordered for any reason, without the need to provide explanations and without any penalty;
(b) only the customer who purchases the goods for purposes unrelated to his economic and work activities may exercise the right of withdrawal, providing for billing his tax code and not the VAT number;
(c) The right of withdrawal must be exercised by the Customer, in the term a), by emailing Naturalmente Marylin via info@naturalmentemarylin.it or by telephone on 324 093 7148.

The right of withdrawal is excluded in the following cases, under art. 59 d.lgs 21/2014:
– order of custom-made or clearly customized products;
– Order of Products that are likely to deteriorate or expire quickly;
– Order of sealed products that do not lend themselves to be returned for hygiene or health protection reasons or that have been opened after delivery.

1.2 Contents of the withdrawal declaration
The withdrawal declaration communicated by the customer must necessarily contain:
(a) the clear and precise reference to the order for which you want to exercise withdrawal;
b) the express declaration of the customer’s willingness to withdraw in all or part of the purchase agreement;
(c) the description and code of the products to which the willingness to withdraw refers;
d) in the case of a transfer refund, the bank details for the bank account where the Customer wishes to receive the relevant refunds.

3 Notice of withdrawal

1.4 Customer’s obligations
The Customer is committed to storing and storing with the diligence of the good father of the family the products for which he intends to exercise the right of withdrawal by keeping them intact in the appropriate original packaging together with all the accessories and documentation of which they are accompanied.

1.5 Returning goods
The Customer is committed to returning the products for which the right of withdrawal has been exercised within no more than 15 days of the notice of his intention to withdraw. The products must be shipped to the operating headquarters of the Selling Company and that is to say at Of course Marylin – Via Piave, 65, 84043 Agropolis (SA) – Italy. The return of products that are unhealthy, damaged or missing of components and/or accessories, including documentation, will not be accepted by the Selling Company, which will return the goods to the customer with increased transport costs. In such circumstances, you will not be able to use the right of withdrawal.

1.6 Refund
Naturalmente Marylin will provide within 14 days of receiving the goods in the terms and conditions on which she has been able to reimburse the customer for the value of the products for which the right of withdrawal has been exercised, including any shipping costs. The shipping costs for the return are entirely borne by the customer.
The refund will be made using the same payment method used by the Customer, unless the customer has expressly requested a different method. In the case of a transfer or payment in the name of the bank, it will be the care of the customer to provide the bank details on which to obtain the refund (the owner of the account, name and address of the Bank and IBAN).

1.7 Damage and deterioration
Under no circumstances will the Customer be able to exercise the right of withdrawal if the goods are damaged and/or deteriorated.
If the product you want to make has already been consumed/partially consumed, or open or otherwise no longer available for sale, please contact the manufacturer as we cannot accept this type of return.

Article 2 : Return

Warranty of refund or free replacement of defective or non-request products.
No claim can be taken into account after 14 days of receipt of the goods and if the material will not be returned to the original packaging. If these requirements are met, the goods will be returned to the sender in the assigned port. However, it is understood that the product guarantee can only be the one offered by the Manufacturers, not taking any additional responsibility of Naturalmente Marylin. Under D.P.R. No. 472 of 14/08/96, the material returned must necessarily be accompanied by a packing slip containing the number and date of the document relating to the disputed product. Although not expressively provided for by these general conditions, the rules of the Civil Code will apply. Naturalmente Marylin you will reserve the right to make any changes to the original business proposal without any commitment, no notice.
